Jack Reale and Bob Quinn obtained summary judgment in an accidental shooting case. Judge Pamela South of the State Court of Gwinnett County granted summary judgment in favor of the owner of the property and the LLC operating on the premises in an accidental shooting case in which the plaintiff was seriously injured, incurring medical expenses in excess of $150,000. The Plaintiff made a policy limits demand of $1 million.
Mr. Reale and Mr. Quinn convinced Judge South that plaintiff was a licensee instead of an invitee at the time of the incident and that there was no evidence to show any willful or wanton conduct on behalf of the defendants. The Court further ruled that there was no evidence that the shooter was an employee of defendants acting in the scope and course of his employment. Finally, the Court agreed with defendants’ interpretation of a Georgia statute finding that the defendants were statutorily immune from liability because even if the shooter was an employee, it was an accident.
