Her client, Signature Research Inc., inspected and certified the safety of a zipline course located in the Dominican Republic. Five months after her client’s last inspection of the course, and after her client recommended certain repairs be made to the course by the owner of the course, a portion of the zipline course failed, resulting in injuries to the Plaintiff. Ms. Marschalk filed a motion to dismiss Plaintiffs’ lawsuit on forum non conveniens grounds. The trial court agreed with Ms. Marschalk and granted her motion, effectively dismissing the suit against Signature Research in Georgia. Plaintiffs appealed to the Georgia Court of Appeals. After receiving extensive briefing and hearing oral argument by the parties in January, the Court of Appeals affirmed the trial court’s decision to dismiss the lawsuit against Ms. Marschalk’s client.
